{"id":48415,"date":"2023-04-18T15:24:46","date_gmt":"2023-04-18T14:24:46","guid":{"rendered":"https:\/\/www.climatechangenews.com\/?p=48415"},"modified":"2023-04-18T15:24:46","modified_gmt":"2023-04-18T14:24:46","slug":"campaigners-sue-eu-for-labelling-gas-sustainable","status":"publish","type":"post","link":"https:\/\/www.climatechangenews.com\/2023\/04\/18\/campaigners-sue-eu-for-labelling-gas-sustainable\/","title":{"rendered":"Campaigners sue EU for labelling gas sustainable"},"content":{"rendered":"<p><strong>Environmental groups\u00a0took\u00a0the European Commission to court\u00a0today after the EU executive rejected their request to withdraw fossil gas from the EU\u2019s sustainable finance taxonomy.<\/strong><\/p>\n<p><span data-preserver-spaces=\"true\">In a controversial move last year, the <a href=\"https:\/\/climatechangenews.com\/2022\/07\/06\/eu-set-to-use-green-label-for-gas-nuclear-investments-after-parliamentary-vote\/\" target=\"_blank\" rel=\"noopener\">European Commission gave<\/a> gas power plants a \u2018sustainable\u2019 label under the EU\u2019s green finance taxonomy, provided they meet a strict CO2 emissions threshold.<\/span><\/p>\n<p>Gas power plants will be considered as a \u201ctransitional\u201d technology under the EU taxonomy provided they replace existing coal-fired power stations, and \u201csubject to clear limits and phase-out periods\u201d, the EU executive said.<\/p>\n<p>That decision was challenged\u00a0<span data-preserver-spaces=\"true\">by four environmental groups \u2013 ClientEarth, WWF\u2019s European Policy Office, Transport &amp; Environment (T&amp;E), and BUND (Friends of the Earth Germany).<\/span><\/p>\n<blockquote><p><a href=\"https:\/\/climatechangenews.com\/2023\/04\/17\/japan-us-and-eu-block-g7-from-setting-coal-phase-out-date\/\" target=\"_blank\" rel=\"noopener\"><strong>Japan, US<\/strong> and EU block G7 from setting coal phase out date<\/a><\/p><\/blockquote>\n<p><span data-preserver-spaces=\"true\">The four<\/span><span data-preserver-spaces=\"true\">\u00a0<a class=\"editor-rtfLink\" href=\"https:\/\/www.clientearth.org\/latest\/press-office\/press\/eu-taxonomy-environmental-groups-start-legal-action-against-sustainable-gas-classification\/\" target=\"_blank\" rel=\"noopener\">started legal action in September<\/a>\u00a0to stop the inclusion of fossil gas in the bloc\u2019s sustainable finance rulebook, arguing that the legislation clashes with the European Climate Law and does not respect the EU\u2019s obligations under the Paris Agreement.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">However, in February the Commission rejected their request, and the NGOs are now challenging this decision by filing a case with the Court of Justice of the European Union.\u00a0<\/span><\/p>\n<h3>Absurd and unlawful?<\/h3>\n<p><span data-preserver-spaces=\"true\">\u201cLabelling fossil gas as \u2018sustainable\u2019 is as absurd as it is unlawful. It goes against the EU\u2019s own scientific advice and fundamentally undermines the credibility of the EU\u2019s climate action. Fossil gas is not clean, not cheap and not a secure source of energy,\u201d said a spokesperson for the four green organisations.\u00a0<\/span><\/p>\n<blockquote><p><a href=\"https:\/\/climatechangenews.com\/2023\/04\/14\/saudi-arabia-russia-push-for-more-world-bank-money-into-carbon-capture\/\" target=\"_blank\" rel=\"noopener\"><strong>Saudi Arabia, Russia<\/strong> push for more World Bank money into carbon capture<\/a><\/p><\/blockquote>\n<p><span data-preserver-spaces=\"true\">The NGOs argue that gas cannot be considered a sustainable source of energy and has a huge impact on climate change as it is a high-carbon source when burnt, while its extraction and transport also lead to the release of methane, a powerful greenhouse gas.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Including fossil gas in the \u2018green\u2019 taxonomy would also worsen the EU\u2019s dependency on imported fossil fuels, exposing EU member states to more price volatility, dependence on producing countries, and supply crises in the future, they add.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">\u201cWe\u2019re taking the Commission to court in the hope of restoring some credibility to the Taxonomy and avoiding this huge risk to the climate and people\u2019s energy security,\u201d the spokesperson said.\u00a0<\/span><\/p>\n<blockquote><p><a href=\"https:\/\/climatechangenews.com\/2023\/04\/14\/life-or-death-weather-watchers-warn-against-elon-musks-twitter-changes\/\" target=\"_blank\" rel=\"noopener\"><strong>\u201cLife or death\u201d:<\/strong> Weather-watchers warn against Elon Musk\u2019s Twitter changes<\/a><\/p><\/blockquote>\n<p>Contacted by Euractiv, a Commission spokesperson said the EU executive \u201ctakes note of the legal action undertaken by several NGOs\u201d but prefers not to comment on the substance of the case \u201cbefore EU Court judgments are delivered\u201d.<\/p>\n<p><span data-preserver-spaces=\"true\">A hearing at the General Court is being scheduled for the second half of 2024, with a judgement expected to be released in 2025.<\/span><\/p>\n<h3><span data-preserver-spaces=\"true\">Nuclear challenged too<\/span><\/h3>\n<p><span data-preserver-spaces=\"true\">A separate lawsuit at the Luxembourg-based European Court of Justice against the inclusion of gas and nuclear in the taxonomy regulation will also be filed by Greenpeace on Tuesday.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">In September, Greenpeace organisations from eight countries asked the EU to review its decision, but their request was rejected.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">As the lawsuit is being filed on Tuesday, activists from Greenpeace Luxembourg are planning to gather in front of the Court to protest the \u201cgreen\u201d label for gas and nuclear.\u00a0<\/span><\/p>\n<p>Unlike gas, nuclear is a zero-carbon technology. But Greenpeace <a href=\"https:\/\/www.greenpeace.org.uk\/challenges\/nuclear-power\/\" target=\"_blank\" rel=\"noopener\">opposes it<\/a> due to concerns over the disposal of nuclear waste and about
