{"id":43131,"date":"2020-12-16T11:33:13","date_gmt":"2020-12-16T11:33:13","guid":{"rendered":"https:\/\/www.climatechangenews.com\/?p=43131"},"modified":"2020-12-16T11:36:41","modified_gmt":"2020-12-16T11:36:41","slug":"uk-supreme-court-lifts-ban-heathrow-airport-third-runway","status":"publish","type":"post","link":"https:\/\/www.climatechangenews.com\/2020\/12\/16\/uk-supreme-court-lifts-ban-heathrow-airport-third-runway\/","title":{"rendered":"UK Supreme Court lifts ban on Heathrow airport third runway\u00a0"},"content":{"rendered":"<p><strong>The UK Supreme Court ruled on Wednesday that Heathrow would not be banned from building a third runway, following a historic court case between climate campaigners and Europe\u2019s busiest airport.\u00a0<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Plans for a third runway had stalled after the Court of Appeal ruled in February that the <\/span><a href=\"https:\/\/www.climatechangenews.com\/2020\/02\/27\/uks-heathrow-airport-expansion-ruled-unlawful-climate-change\/\"><span style=\"font-weight: 400;\">expansion was <\/span><span style=\"font-weight: 400;\">unlawful<\/span><\/a><span style=\"font-weight: 400;\"> because, among other reasons, it failed to consider the Paris Agreement on climate change.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Supreme Court overturned the ban and ruled that Heathrow\u2019s expansion strategy was not illegal, stating that the Paris Agreement does not qualify as UK government policy.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Tim Crosland, a lawyer at Plan B, which brought the case along with Friends of the Earth, described it as a \u201creally dreadful ruling\u201d.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe have so many documents from the UK government saying that the Paris Agreement is the lynchpin of policy on climate change and that we were the ones that were instrumental in securing it,\u201d he told Climate Home.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In his anger at the verdict, Crosland broke an embargo to reveal the outcome on Tuesday, at risk of being held in contempt of court.<\/span><\/p>\n<blockquote><p><a href=\"https:\/\/www.climatechangenews.com\/2020\/11\/26\/eu-urged-address-aviations-full-climate-impact-including-non-co2-emissions\/\"><strong>EU urged<\/strong> to address aviation\u2019s full climate impact, including non-CO2 emissions<\/a><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">Campaigners plan to appeal the ruling in the European Court of Human Rights in Strasbourg, where they will argue that increasing aviation emissions is inconsistent with the right to life.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Despite the ruling, <\/span><span style=\"font-weight: 400;\">Heathrow still faces major obstacles to carry out its expansion plans. The airport may now seek planning permission, but could struggle to convince a public enquiry that increasing aviation demand is compatible with the UK\u2019s 2050 net zero target, campaigners say.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThis judgment is no \u2018green light\u2019 for expansion. With ever stronger climate policy commitments that Heathrow must meet, it remains unlikely it will ever get planning permission for the third runway,\u201d said Will Rundle, head of legal at Friends of the Earth.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Climate Change Committee (CCC) advised this month that if the UK is to meet its 2050 net zero goal, it will have to <\/span><a href=\"https:\/\/www.theccc.org.uk\/publication\/sixth-carbon-budget\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">reduce its overall aviation emissions<\/span><\/a><span style=\"font-weight: 400;\">. There is no net airport growth in its net zero scenario, meaning Heathrow expansion would have to be offset by capacity reductions elsewhere.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cHeathrow expansion means 40 million tonnes of carbon dioxide, just from UK aviation, by 2050. They have to explain how that is consistent with the UK 2050 net zero target,\u201d said Crosland.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Aviation is likely to be the UK\u2019s highest emitting sector by 2050, as it is hard to decarbonise, according to the <\/span><a href=\"https:\/\/www.theccc.org.uk\/wp-content\/uploads\/2019\/09\/Letter-from-Lord-Deben-to-Grant-Shapps-IAS.pdf\"><span style=\"font-weight: 400;\">CCC<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<blockquote><p>Climate news in your inbox?<strong>\u00a0Sign up\u00a0<a href=\"https:\/\/www.climatechangenews.com\/newsletter-sign-up\/\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a><\/strong><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">Heathrow emits around <\/span><a href=\"https:\/\/airportwatch.org.uk\/wp-content\/uploads\/AirportWatch-briefing-on-CO2-emissions-and-new-runway-January-2015.pdf\"><span style=\"font-weight: 400;\">19 million tonnes of CO2<\/span><\/a><span style=\"font-weight: 400;\"> a year, more than half of UK aviation emissions. A third runway would add a projected <\/span><a href=\"https:\/\/airportwatch.org.uk\/wp-content\/uploads\/AirportWatch-briefing-on-CO2-emissions-and-new-runway-January-2015.pdf\"><span style=\"font-weight: 400;\">9 million tonnes to the airport\u2019s total annual CO2 output<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p>Aviation demand projections have been thrown into uncertainty by the impact of the coronavirus pandemic, which forced airline to ground planes for much of 2020.<\/p>\n<p><span style=\"font-weight: 400;\">Without political will, the expansion plans are unlikely to happen, Friends of the Earth previously told Climate Home. Prime minister Boris Johnson, whose constituency is close to Heathrow, has been an outspoken critic of a third runway in the past.<\/span><\/p>\n<p>John Sauven, executive director of Greenpeace UK, said in a statement: &#8220;Now the ball is in the government\u2019s court, it\u2019s hard to imagine Boris Johnson wanting to resurrect a project that makes no business or environmental sense. With a UK-hosted climate summit just a year away, the government should draw a line under this sorry saga.&#8221;<\/p>\n<p>Sauven called for a frequent flyer levy to curb demand and investment in broadband to encourage video conferencing instead of business flights.<\/p>\n<p><span style=\"font-weight: 400;\">A spokesperson for Heathrow said: \u201cHeathrow airport has already committed to net zero and this ruling recognises the robust planning process that will require us to prove expansion is compliant with the UK\u2019s climate change obligations, including the Paris Climate Agreement,
