{"id":42620,"date":"2020-10-08T16:37:54","date_gmt":"2020-10-08T15:37:54","guid":{"rendered":"https:\/\/www.climatechangenews.com\/?p=42620"},"modified":"2020-10-12T12:06:23","modified_gmt":"2020-10-12T11:06:23","slug":"uk-supreme-court-hears-climate-case-heathrow-airport-expansion","status":"publish","type":"post","link":"https:\/\/www.climatechangenews.com\/2020\/10\/08\/uk-supreme-court-hears-climate-case-heathrow-airport-expansion\/","title":{"rendered":"UK Supreme Court hears climate case on Heathrow airport expansion"},"content":{"rendered":"<p><strong>Heathrow appeared in front of the UK Supreme Court this week in a bid to overturn a judgment that blocked Europe\u2019s busiest airport from expanding.\u00a0<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">In February, campaigners claimed a <a href=\"https:\/\/www.climatechangenews.com\/2020\/02\/27\/uks-heathrow-airport-expansion-ruled-unlawful-climate-change\/\">historic victory in the Court of Appeal<\/a>, which quashed plans for a third runway at Heathrow on climate grounds. <\/span><span style=\"font-weight: 400;\">The case was brought by litigation charity Plan B and campaign group Friends of the Earth.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Three appeal judges ruled that government approval of the expansion plan was unlawful because, among other reasons, it failed to consider the Paris Agreement on climate change. T<\/span><span style=\"font-weight: 400;\">o pursue the project, the transport secretary<\/span><span style=\"font-weight: 400;\"> would have to review how it could fit with the country\u2019s climate commitments. The transport department accepted the ruling and said it would not appeal.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In a two-day virtual sitting of the Supreme Court this week, Heathrow <\/span><span style=\"font-weight: 400;\">argued the government was not legally required to consider the Paris Agreement.<\/span><\/p>\n<p>At the same time, the airport owners claimed a third runway was compatible with Paris, so a government review would ultimately conclude it could go ahead.<\/p>\n<p>According to the UK <a href=\"https:\/\/www.theccc.org.uk\/wp-content\/uploads\/2019\/09\/Letter-from-Lord-Deben-to-Grant-Shapps-IAS.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Committee on Climate Change<\/a>, aviation is likely to be the UK&#8217;s highest emitting sector by 2050, as it is hard to decarbonise. Heathrow currently emits around <span style=\"font-weight: 400;\"><a href=\"https:\/\/airportwatch.org.uk\/wp-content\/uploads\/AirportWatch-briefing-on-CO2-emissions-and-new-runway-January-2015.pdf\"> 19 million tonnes of CO2<\/a> a year, more than half of UK aviation emissions. A third runway would add a projected <\/span><a href=\"https:\/\/airportwatch.org.uk\/wp-content\/uploads\/AirportWatch-briefing-on-CO2-emissions-and-new-runway-January-2015.pdf\">9 million tonnes to the airport&#8217;s total annual CO2 output<\/a>.<\/p>\n<p><span style=\"font-weight: 400;\">A spokesperson for Heathrow airport said: \u201c<\/span><span style=\"font-weight: 400;\">Heathrow will ensure the expansion project is compliant with the UK\u2019s climate change obligations, including under the Paris Climate Agreement, as part of our plans to reach net-zero carbon. We fully expect to be held to account by the government through the planning process.\u201d<\/span><\/p>\n<blockquote><p><a href=\"https:\/\/www.climatechangenews.com\/2020\/10\/06\/us-emissions-four-years-president-trump\/\"><strong>Read more:<\/strong> Where are US emissions after four years of Donald Trump?\u00a0<\/a><\/p><\/blockquote>\n<p><span style=\"font-weight: 400;\">Friends of the Earth lawyer Katie de Kauwe questioned this argument in Heathrow\u2019s appeal. <\/span><span style=\"font-weight: 400;\">\u201cIf it really makes no difference to the outcome, then why are you bringing the appeal?\u201d she asked, in an interview with Climate Home. \u201cWhy not let the government conduct its review?\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">De Kauwe said that if the Supreme Court agrees with the previous ruling the government&#8217;s airports national policy statement will remain a \u201czombie policy\u201d until the government reviews it. Without political will, the expansion plans are unlikely to happen, she said. Prime minister Boris Johnson, whose constituency is close to Heathrow, has been an outspoken critic of a third runway in the past.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The verdict is expected in January.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">De Kauwe described the case as \u201chugely significant\u201d. \u201cIt is the first case that has ruled that government plans for a massive infrastructure project are unlawful on the basis of the Paris Agreement,\u201d she said.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Campaigners and lawyers say the verdict could set a precedent for other climate litigation cases relating to the Paris Agreement.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThis case is being closely watched by lawyers around the world who want to see how much impact a country&#8217;s signature to the Paris Climate Agreement has on actual decision-making\u201d Michael Gerrard, an environmental law professor at Columbia University in New York, told Climate Home.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cThe ruling by the Court of Appeal seems to give at least some teeth to Paris.\u00a0 The Supreme Court will either cement or pull those teeth,\u201d Gerrard said.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cWe are seeing a movement across the world of climate litigation,\u201d said de Kauwe. Campaign group Transport Action Network is challenging the <\/span><a href=\"https:\/\/www.crowdjustice.com\/case\/stop-largest-ever-roads-programme\/\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">UK government\u2019s largest-ever road building programme<\/span><\/a><span style=\"font-weight: 400;\"> by building on the Heathrow result, she said. \u201cIt is a huge boost for climate campaigners, [showing] what can be achieved through the courts.\u201d<\/span><\/p>\n<p><em>This article has been amended to remove an incorrect reference to the
