{"id":42458,"date":"2020-09-15T16:59:37","date_gmt":"2020-09-15T15:59:37","guid":{"rendered":"https:\/\/www.climatechangenews.com\/?p=42458"},"modified":"2020-09-15T16:59:37","modified_gmt":"2020-09-15T15:59:37","slug":"energy-companies-keep-right-sue-states-private-courts-treaty-reforms-blocked","status":"publish","type":"post","link":"https:\/\/www.climatechangenews.com\/2020\/09\/15\/energy-companies-keep-right-sue-states-private-courts-treaty-reforms-blocked\/","title":{"rendered":"Energy companies keep right to sue states in private courts, as treaty reforms blocked"},"content":{"rendered":"<p><strong>Negotiators have ruled out an overhaul of private courts that allow energy companies to sue national governments when climate change policies hurt their profits.<\/strong><\/p>\n<p>In the past year, fossil fuel companies have used the Energy Charter Treaty to <a href=\"https:\/\/www.climatechangenews.com\/2020\/09\/09\/fracking-company-sues-slovenia-unreasonable-environmental-protections\/\">sue the Slovenian government<\/a> over environmental protections and <a href=\"https:\/\/www.climatechangenews.com\/2020\/05\/21\/uniper-uses-investment-treaty-fight-netherlands-coal-phaseout\/\">challenge the Dutch government<\/a>&#8216;s coal phaseout plan.<\/p>\n<p>Similar cases could cost taxpayers across the world up to \u20ac1.3 trillion ($1.5tn) by 2050, <a href=\"https:\/\/www.openexp.eu\/publications\/modernisation-energy-charter-treaty-global-tragedy-high-cost-taxpayers\" target=\"_blank\" rel=\"noopener noreferrer\">according to the Open Exp think tank<\/a>, based on the value of coal, oil and gas assets protected by the treaty.<\/p>\n<p>Around 42% of these costs would fall on the EU. The bloc is pushing for amendments of the treaty to support climate goals, including replacing the investor state dispute settlement (ISDS) model with something more transparent.<\/p>\n<p>But at &#8220;modernisation&#8221; talks between the 53 signatories of the pact last week, Japan and central Asian countries refused to entertain fundamental changes to the ISDS system.<\/p>\n<blockquote><p><a href=\"https:\/\/www.climatechangenews.com\/2020\/09\/08\/japan-blocks-green-reform-major-energy-investment-treaty\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Japan blocks<\/strong> green reform of major energy investment treaty<\/a><\/p><\/blockquote>\n<p>In its <a href=\"https:\/\/www.energycharter.org\/media\/news\/article\/public-communication-on-the-second-negotiation-round-on-the-modernisation-of-the-energy-charter-trea\/?tx_news_pi1%5Bcontroller%5D=News&amp;tx_news_pi1%5Baction%5D=detail&amp;cHash=284d1595d54f1d36a3cccb1dbee035fb\" target=\"_blank\" rel=\"noopener noreferrer\">statement on the talks<\/a>, the ECT secretariat said: \u201cNo consensus was reached on a request by one delegation to discuss a broader reform of ISDS beyond the list of topics for modernisation.&#8221;<\/p>\n<p>Investment law expert at the Columbia Center on Sustainable Investment Lise Johnson told Climate Home News the talks were \u201ca missed opportunity&#8221; and &#8220;risk locking in the same unsustainable status quo\u201d.<\/p>\n<p>Harro van Asselt, climate law professor at the University of Eastern Finland, said replacing the ISDS is just one of several possible ways of \u2018greening\u2019 the ECT. &#8220;Such proposals could still be pursued under the current list of topics for modernisation. However, the unwillingness by some parties to even discuss these issues does not bode well for reform efforts,\u201d he concluded.<\/p>\n<p>Proposals still on the table include measures to deter frivolous claims and regulate the role of &#8220;no win, no fee&#8221; litigation finance companies.<\/p>\n<p>Kyla Tienharaa, assistant professor of environmental studies at Canada\u2019s Queen\u2019s University said if fully pursued, these changes might help prevent lawsuits by fossil fuel companies bankrupted in the transition to clean energy. But negotiators were merely &#8220;tinkering&#8221; and &#8220;ultimately, in my view, termination [of the treaty] is the way to go\u201d.<\/p>\n<p>Friends of the Earth campaigner Paul de Clerk said the decision not to discuss broader reform, shows \u201cthe ECT will continue to promote an ISDS model that was declared unacceptable by the EU and its member states a couple of years ago. Therefore, it is time to leave the ECT.&#8221;<\/p>\n<blockquote><p><span style=\"font-weight: 400;\">Climate news in your inbox?<\/span><b> Sign up <\/b><a href=\"https:\/\/www.climatechangenews.com\/newsletter-sign-up\/\"><b>here<\/b><\/a><\/p><\/blockquote>\n<p>Several European politicians have said the EU should consider pulling out of the treaty if it doesn&#8217;t achieve meaningful reform. Italy and Russia left the ECT after legal action was brought against them, although a \u2018sunset clause\u2019 means the treaty\u2019s provisions apply for 20 years after the exit date.<\/p>\n<p>The head of the ECT secretariat, Urban Rusn\u00e1k, has said that if modernisation talks fail, there is no future for the treaty. But he insisted it could be a positive force for climate protection in a <a href=\"https:\/\/www.energycharter.org\/fileadmin\/DocumentsMedia\/Other_Publications\/A_new_Energy_Charter_Treaty_as_a_complement_to_the_Paris_Agreement.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">June interview with Borderlex<\/a>.<\/p>\n<p>\u201cApart from the Yukos case, damages awarded under arbitration cases up to now are twice as high in the renewable energy sector as in fossil fuels. Yet somehow the NGOs fail to mention this,\u201d he told Borderlex.<\/p>\n<p>The treaty&#8217;s disintegration \u201cwould seriously hamper the ability of the world to meet the Paris climate targets,\u201d Rusn\u00e1k said. Unlike Paris, the ECT protects investments, he said, and so the two are complementary.<\/p>\n<blockquote><p><a href=\"https:\/\/www.climatechangenews.com\/2020\/09\/09\/fracking-company-sues-slovenia-unreasonable-environmental-protections\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Fracking company sues<\/strong> Slovenia over &#8216;unreasonable&#8217; environmental protections<\/a><\/p><\/blockquote>\n<p>In response to this point, Johnson said that renewable subsidies were important but &#8220;it is dangerous if we use the treaty to lock in unsustainable incentive schemes&#8221;. She said governments needed the ability to review and withdraw subsidies if they were not catalysing investment or were an &#8220;excessive&#8221; use of taxpayers&#8217; money.<\/p>\n<p>These talks were the second of three \u2018clarification rounds\u2019 this year, meaning that no substantive decisions were expected. There will be a further clarification round in November before a progress report is submitted to the ECT\u2019s December conference and then negotiations will continue throughout
