{"id":41401,"date":"2020-02-27T14:36:04","date_gmt":"2020-02-27T14:36:04","guid":{"rendered":"https:\/\/www.climatechangenews.com\/?p=41401"},"modified":"2020-02-27T14:36:04","modified_gmt":"2020-02-27T14:36:04","slug":"uks-heathrow-airport-expansion-ruled-unlawful-climate-change","status":"publish","type":"post","link":"https:\/\/www.climatechangenews.com\/2020\/02\/27\/uks-heathrow-airport-expansion-ruled-unlawful-climate-change\/","title":{"rendered":"UK&#8217;s Heathrow airport expansion ruled unlawful over climate change"},"content":{"rendered":"<p><strong>Campaigners in the UK have hailed an \u201chistoric\u201d victory for climate change after three judges ruled expansion plans for the country&#8217;s busiest airport to be unlawful.<\/strong><\/p>\n<p>Activists erupted into cheers at the Royal Courts of Justice in London after successfully blocking plans for a third runway at Heathrow airport.<\/p>\n<p>Lord Justice Lindblom found that the plans backed by\u00a0<span class=\"caps\">MP<\/span>s disregarded the\u00a0<span class=\"caps\">UK<\/span>\u2019s Paris Agreement pledge in 2015 to reduce carbon emissions to 1.5C or \u201cwell below\u201d 2C\u00a0warming.<\/p>\n<p><span class=\"dquo\">\u201c<\/span>We have concluded that the designation of\u00a0<span class=\"caps\">ANPS<\/span> (Airports National Policy Statement) was unlawful by reason of a failure to take into account the government\u2019s commitment to the provisions of the Paris Agreement on climate change,\u201d he told the packed courtroom in central London.<\/p>\n<p>The ruling could have an impact both in the UK and elsewhere around the world, emboldening campaigners to file legal challenges against other carbon-intensive infrastructure projects.<\/p>\n<p>The failure of the UK&#8217;s Secretary of State to justify the plans had been \u201clegally fatal,&#8221; Lord Justice Lindblom added. But the judges dismissed other appeals against the UK Government, including on challenges relating to noise and air quality.<\/p>\n<p>The ruling came after green groups teamed up with London Mayor Sadiq Khan and local authorities affected by the proposal to mount a series of legal challenges against the\u00a0expansion.<\/p>\n<blockquote><p><a href=\"https:\/\/www.climatechangenews.com\/2020\/02\/27\/net-zero-goal-greatest-commercial-opportunity-time-says-mark-carney\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Net zero goal<\/strong> \u2018greatest commercial opportunity of our time,\u2019 says Mark Carney<\/a><\/p><\/blockquote>\n<p>Plans for a third runway \u2013 which had been on track to open in 2028-29 &#8211; would have rerouted rivers, roads and the\u00a0<span class=\"caps\">M25<\/span>\u00a0and contributed an estimated 3-4million tonnes to\u00a0<span class=\"caps\">UK<\/span>\u2019s carbon emissions. The cost of the project was initially estimated at \u00a314 billion ($17.8bn) but has since risen to \u00a332bn ( $40.6).<\/p>\n<p>Head of Legal at Friends of the Earth, William Rundle, said: \u201cIt\u2019s an historic victory for the climate and for the local communities fighting the Heathrow expansion for so very, very long.<\/p>\n<p>\u201cWhat we\u2019ve managed to do is to stop the Heathrow expansion dead in the tracks. The government\u2019s plan has been found to be illegal because they didn\u2019t consider climate change properly, and shockingly, took legal advice that the Paris Agreement was not relevant.<\/p>\n<p><span class=\"dquo\">\u201c<\/span>At the time of the climate emergency this is an attitude that we really need, and we are really celebrating the Court of Appeal\u2019s judgment. We need to put a halt to aviation\u00a0expansion.\u201d<\/p>\n<p>Speaking outside the court, London mayor Khan said the decision was a victory for Londoners and for \u201cfuture generations\u201d.<\/p>\n<p>He told reporters: \u201cWhat the government should now do is not tinker, not tweak with their airports and national policy statement. Instead what they should do is abandon any plans for a new runway at\u00a0Heathrow.\u201d<\/p>\n<blockquote><p>Climate news in your inbox?<strong>\u00a0Sign up\u00a0<a href=\"https:\/\/www.climatechangenews.com\/newsletter-sign-up\/\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a><\/strong><\/p><\/blockquote>\n<p>Prime Minister Boris Johnson, who in 2015 vowed to \u201clie down before the bulldozers\u201d to oppose the third runway, has been noncommittal about the airport in the intervening five years, saying recently: \u201cThe bulldozers are some way off but I am following with lively interest the court\u00a0cases\u201d.<\/p>\n<p>While the Court of Appeal does not have the scope to rule out the expansion going ahead, the ruling means the plans will now be subjected to renewed scrutiny in Parliament amid increased public pressure to meet its climate\u00a0pledges.<\/p>\n<p>Heathrow Airport and fellow supporters of the scheme have long argued that the expansion would bring considerable regional and national benefits as well as boost\u00a0<span class=\"caps\">GDP<\/span>\u00a0growth to the\u00a0<span class=\"caps\">UK<\/span>\u00a0after\u00a0Brexit.<\/p>\n<p>Today\u2019s ruling came as the airport yesterday announced its ninth consecutive year of passenger growth, welcoming a record 80.9 million passengers last\u00a0year.<\/p>\n<p>However, a\u00a0<a href=\"https:\/\/neweconomics.org\/2020\/02\/heathrow-third-runway-could-shift-43bn-gdp-to-london-and-the-south-east\" target=\"_blank\" rel=\"noopener noreferrer\">report by the think tank New Economics Foundation<\/a>\u00a0(<span class=\"caps\">NEF<\/span>) found that an expansion would do the opposite of \u201clevelling up\u201d, by shifting jobs, carbon emissions and\u00a0<span class=\"caps\">GDP<\/span>\u00a0from other regions into London and the south east from the North of\u00a0England.<\/p>\n<p>They also said the\u00a0<span class=\"caps\">UK<\/span>\u00a0would be \u201cblowing its carbon budget\u201d \u2013 and that the 3-4 million tonnes of carbon emissions would be equivalent to the footprint of 100,000 jobs in\u00a0manufacturing.<\/p>\n<blockquote><p><a href=\"https:\/\/www.climatechangenews.com\/2020\/02\/26\/netherlands-faces-pressure-global-test-case-deep-emissions-cuts-2020\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>The Netherlands<\/strong> faces pressure as global \u2018test case\u2019 for deep emissions cuts in 2020<\/a><\/p><\/blockquote>\n<p>UK lawmakers backed the expansion by 415-119 votes in June 2018, after Labour leader Jeremy Corbyn gave his party a free vote. Sadiq Khan\u2019s initial court challenge was unsuccessful, but the group was given leave to appeal in October last year.<\/p>\n<p>Responding to the ruling, a Heathrow Airport spokesperson said the challenge on climate change front was \u201ceminently fixable\u201d and pledged to \u201cget Heathrow done\u201d\u00a0regardless.<\/p>\n<p><span class=\"dquo\">\u201c<\/span>We will appeal to the Supreme Court on this one issue and are confident that we will be successful,\u201d they\u00a0said.<\/p>\n<p><span class=\"dquo\">\u201c<\/span>In the meantime, we are ready to work with the government to fix the issue that the court has raised. Heathrow has taken a lead in getting the <span class=\"caps\">UK<\/span> aviation sector to commit to a plan to get to net zero emissions by 2050, in line with the Paris Accord.<\/p>\n<p><span class=\"dquo\">\u201c<\/span>Expanding Heathrow, Britain\u2019s biggest port and only hub, is essential to achieving the prime minister\u2019s vision of Global Britain.
