{"id":38885,"date":"2019-03-08T12:29:34","date_gmt":"2019-03-08T12:29:34","guid":{"rendered":"https:\/\/www.climatechangenews.com\/?p=38885"},"modified":"2019-03-08T13:00:08","modified_gmt":"2019-03-08T13:00:08","slug":"belfasts-bid-join-uk-environment-law-raises-post-brexit-border-issues","status":"publish","type":"post","link":"https:\/\/www.climatechangenews.com\/2019\/03\/08\/belfasts-bid-join-uk-environment-law-raises-post-brexit-border-issues\/","title":{"rendered":"Belfast&#8217;s bid to join UK environment law raises post-Brexit border issues"},"content":{"rendered":"<p><strong>Northern Ireland wants to be part of London&#8217;s new post-Brexit environment law &#8211; raising new complications in regulating border-defying pollutants across a land border with the EU.\u00a0<\/strong><\/p>\n<p>UK environment policy is devolved to the Scottish, Welsh and Northern Irish governments. The UK government&#8217;s draft Environment Bill is therefore limited to England &#8211; and risks leading to diverging rules and regulatory gaps once Britain leaves the European Union.<\/p>\n<p>To avoid protection gaps, Northern Ireland has asked to be part of the bill, and is now talking to the UK government about how to apply it, according to a <a href=\"https:\/\/www.parliament.uk\/documents\/commons-committees\/environmental-audit\/correspondence\/190227-Dr-Denis-McMahon-to-Chair-environment-bill.pdf\" target=\"_blank\">letter<\/a> published by the House of Commons&#8217; Environmental Audit Committee on Friday.<\/p>\n<p>The decision was based on\u00a0concerns that Northern Ireland&#8217;s environmental protections would otherwise be weakened after Brexit, Northern Ireland&#8217;s permanent secretary for the environment Denis McMahon wrote.\u00a0It would not be possible for Northern Ireland to fill those regulatory gaps with its own legislation because it has not had a sitting assembly since 2017, he added.<\/p>\n<p>However, applying the environment law to Northern Ireland presents new complications:\u00a0how to\u00a0regulate free flowing air and water pollutants\u00a0across\u00a0a land border with the EU, and how to manage protected sites\u00a0now\u00a0shared between Northern Ireland and Ireland, the letter noted.<\/p>\n<p>Belfast and London are looking at how these issues would affect the remit of the <a href=\"https:\/\/www.climatechangenews.com\/2019\/03\/06\/new-uk-green-watchdog-based-eu-system-says-gove\/\" target=\"_blank\">new watchdog<\/a>, known as the Office for Environmental Protection.<\/p>\n<p>The answer, according to Labour MP Mary Creagh, is a softer Brexit.<\/p>\n<p class=\"x_MsoNormal\">Adding Northern Ireland to the environment regime\u00a0may require the rest of the UK to keep regulatory alignment with the EU under the Irish backstop arrangement\u00a0&#8211; &#8220;effectively requiring the whole of the UK to stay within a customs union and single market&#8221;, said Creagh, chair of the Environmental Audit Committee.<\/p>\n<p class=\"x_MsoNormal\">However, there are still concerns that environmental protections in Scotland and Wales will diverge if London presses ahead with its Environment Bill rather than building a system with the devolved governments. Scotland <a href=\"https:\/\/consult.gov.scot\/environment-forestry\/environmental-principles-and-governance\/\">opened a consultation<\/a> on how to maintain environmental governance after Brexit in February, which closes in May, and Wales is expected to start one later this month.<\/p>\n<p class=\"x_MsoNormal\"><b><\/b>\u00a0\u201cIt creates an anomaly for Scotland in terms of animal and plant protection and highlights the importance of our recommendations that the Office for Environmental Protection must be co-designed and co-owned by all the nations of the UK in order to be more resilient, independent and effective,&#8221; Creagh said.<\/p>\n<blockquote><p><strong>Global issues need global coverage<\/strong><\/p>\n<p>CHN is dedicated to bringing you the best climate reporting from around the world.
